The Trump administration scored an important, and surprising, legal victory when a U.S. appellate court panel ruled that \u201ccommunity policing\u201d<\/a> grants can be withheld from sanctuary cities that refuse to cooperate with federal immigration agents.<\/p>\n\n\n\n

Los Angeles police officials<\/a> had requested $3.125 million in \u201cCommunity Oriented Policing Services\u201d (COPS) funding to hire 25 officers to \u201cbuild trust and respect.\u201d Though LA is home to an estimated 1 million illegal aliens<\/a>, the city\u2019s application did not cite \u201cillegal immigration\u201d as a reason for the new hires. Nor did it indicate officers would cooperate with federal authorities to help deport illegal aliens from local jails.<\/p>\n\n\n\n

Those two omissions\nturned out to be costly. The Department of Justice (DOJ) rejected the city\u2019s\nbid, and a three-member panel of the Ninth Circuit Court of Appeals upheld the\ndenial this month.<\/p>\n\n\n\n

\u201c[The DOJ] has reasonably determined that illegal immigration enforcement is a public safety issue\u201d that can be addressed through \u201cthe principles of community policing,\u201d Judge Sandra Ikuta wrote in the 2-1 decision<\/a>.<\/p>\n\n\n\n

\u201cCooperation relating to enforcement of federal\nimmigration law is in pursuit of the general welfare, and meets the low bar of\nbeing germane to the federal interest in providing the funding to address crime\nand disorder problems, and otherwise … enhance public safety … one of the\nmain purposes for which the grant is intended,\u201d she concluded.<\/p>\n\n\n\n

Ikuta, appointed by\nPresident George W. Bush, was joined in the majority by fellow Bush appointee\nJay Bybee. In dissent, Judge Kim Wardlaw, appointed by President Bill Clinton,\nargued that the Justice Department illegally \u201cdecided to usurp COPS funds for\nits own immigration policy directives.\u201d<\/p>\n\n\n\n

Judge Wardlaw and sanctuary city officials in LA need to catch up\nwith the times. Since 2017, the DOJ scoring system for competitive COPS grants\nhas awarded extra points to departments seeking to hire officers to help\nfederal authorities deport illegal aliens. <\/p>\n\n\n\n

David Levine, a professor at the University of California Hastings College of the Law, three blocks from the San Francisco-based Ninth Circuit Court, noted: \u201cBefore, the Justice Department was trying to force sanctuary cities to do things, and yank money from them retroactively if they didn\u2019t. Now [DOJ] is saying, \u2018You don\u2019t have to take this money, but if you want it, it comes with strings attached.\u2019 That\u2019s a well-understood way the federal government gets states to do things.\u201d<\/p>\n\n\n\n

Indeed, \u201cstrings\u201d have always been attached to government grants. It\u2019s heartening to see judges on one of the nation\u2019s most liberal courts<\/a> affirming that sanctuary city police departments are not entitled to remuneration for subverting immigration enforcement and flouting U.S. law. <\/p>\n","protected":false},"excerpt":{"rendered":"
