New\nYork\u2019s \u201cGreen Light\u201d<\/a> law is flashing\na brazen red light at federal immigration enforcement. Authorizing driver\u2019s\nlicenses for illegal aliens, the Empire State joins 14 other states in\nundermining public safety and national security.<\/p>\n\n\n\n

As\nFAIR<\/a> noted this\nweek, it \u201cgives license to the normalization of illegal aliens.\u201d<\/p>\n\n\n\n

Right\nout of the gate, county clerks<\/a> were\noverwhelmed, with some reticent about issuing\nlicenses based on a wide array of foreign documents they weren\u2019t familiar with\nand could not interpret.<\/p>\n\n\n\n

Here\u2019s the Department of Homeland Security\u2019s<\/a> interpretation: \u201cBesides\ngiving drivers licenses to hundreds of thousands of people who broke our laws\nand have come to our country illegally, the New York law also blocks DHS law\nenforcement officers who investigate crimes like child exploitation, human trafficking,\nterrorism, the targeting of gang members, sex offenders, and drug smuggling,\nfrom accessing important public records.\u201d<\/p>\n\n\n\n

So,\nwhat is to be done? In addition to suing New York, and perhaps other states over\ntheir slightly less obstructionist laws, some have suggested that Washington\ncould counter on several fronts. Among them, withholding federal highway funds\nas the federal government has done in the past<\/a>\nto \u201cpersuade\u201d states to adopt speed limits or raising the drinking age.<\/p>\n\n\n\n

Whether\nit is withholding targeted federal dollars, or some other course of legal action,\nthe federal government should not just idly stand by. <\/p>\n\n\n\n

New\nYork\u2019s Green Light law creates a massive legal logjam by requiring federal\ncourts to rule on every request for information to the state\u2019s Department of\nMotor Vehicles. U.S. Customs and Border Protection (CBP) and U.S. Immigration\nand Customs Enforcement (ICE) must continue serving administrative subpoenas\nand grand jury subpoenas, forcing the state to expend resources to justify and defend\nits dubious mandate.<\/p>\n\n\n\n

Meantime,\nwhy not do the obvious? Deploy ICE agents at New York\u2019s DMV offices, now\ncrowded with illegal aliens lining up for licenses. That would be the most\nproactive strategy of all.<\/p>\n\n\n\n

As the Center\nfor Immigration Studies<\/a> put it, \u201cLaw-abiding U.S.\ncitizens and aliens legally present in the United States get no benefit from\nNew York\u2019s Green Light law, only problems\ncreated as a result of destroying the integrity of N.Y. driver’s licenses. The\ncatastrophe of 9\/11 was enabled by the lack of security vigilance in our\nimmigration system. Will the next terrorist catastrophe be enabled by the\ndeliberate weakening of vigilance at New York\u2019s Department of Motor Vehicles?\u201d<\/p>\n\n\n\n

Washington\nhas a constitutional duty to resist this dangerous and wholly unnecessary\naggrandizement of state power.<\/p>\n","protected":false},"excerpt":{"rendered":"
