In response to the Biden administration eviscerating<\/a> the nation\u2019s border security and immigration enforcement apparatus, Arizona Attorney General Mark Brnovich released a legal opinion yesterday<\/a> that defined the Biden Border Crisis as an \u2018invasion.\u2019\u00a0 <\/p>\n\n\n\n

This\nclassification can allow states to use enumerated powers granted by the U.S.\nConstitution to defend itself from hostile actors. Transnational gangs and\ncartels facilitating illicit drugs like fentanyl and\/or the movement of\nmigrants across the U.S.-Mexico border would be considered hostile actors in\nthis scenario. <\/p>\n\n\n\n

Article 1 of the Constitution allows States to \u201cengage in War,\u201d when it has been \u201cactually invaded, or in such imminent Danger as will not admit delay\u201d without the approval of Congress. Article IV says the U.S. \u201cshall protest each [state]against invasion\u201d, according to the attorney general\u2019s legal opinion<\/a> and legal recommendations from the Center for Renewing America<\/a>. <\/p>\n\n\n\n

While the legal opinion is one of the most creative, and potentially effective proposals to address the border crisis to date, it ultimately requires<\/a> Arizona Governor Doug Ducey to determine whether the state can use these powers and \u201cestablish exact parameters for the exercise of the defensive use of the force.\u201d<\/p>\n\n\n\n

If approved by the governor, Arizona law enforcement\u2014including police officers and the National Guard\u2014would be allowed to remove<\/a> illegal aliens from the country rather than relying on the Biden administration to remove them. In Fiscal Year 2021, Immigration and Customs Enforcement (ICE) arrests and removals hit historic lows<\/a>, validating Arizona\u2019s efforts to act on its own.\u00a0 <\/p>\n\n\n\n

In Fiscal Year 2021, immigration authorities encountered nearly 2 million illegal aliens<\/a> at the southern border\u2014an all-time high. The Yuma Sector<\/a> in Arizona served as \u201cground zero\u201d for illegal entries toward the end of the fiscal year. <\/p>\n\n\n\n

Arizona\u2019s unique approach is in line with a number of states seeking to find solutions to better address the Biden Border Crisis.

Florida, for instance,
allocated<\/a> millions of dollars to move illegal aliens out of Florida to locations close to those in charge of the nation\u2019s immigration policies\u2014including President Biden\u2019s home state of Delaware. In Texas, Governor Abbott launched<\/a> Operation Lone Star\u2014 a disaster declaration that directs the Department of Public Safety to \u201cuse available resources to enforce all applicable federal and state laws to prevent the criminal activity along the border, including criminal trespassing, smuggling, and human trafficking, and to assist Texas counties in their efforts to address those criminal activities.\u201d <\/p>\n\n\n\n

The Biden administration shows no sign of\nchanging course on its border and immigration policies. Thankfully, creative\nlegal strategies, such as the one being offered by Attorney General Brnovich,\noffer states a way to fight back against administration policies that promote\nlawlessness and criminal behavior at the southern border.<\/p>\n","protected":false},"excerpt":{"rendered":"
