The case was the latest in an ongoing string of immigration scams involving <a href=\"https:\/\/www.dol.gov\/agencies\/whd\/immigration\/h1b\" target=\"_blank\" rel=\"noreferrer noopener\">H-1B<\/a> \u201cskilled\u201d visas. To cite just a few:<\/p>\n\n\n\n<ul><li>An <a href=\"https:\/\/www.hindustantimes.com\/nri-news\/indian-it-company-cloudgen-admits-to-major-h-1b-visa-fraud-101622637026545.html\" target=\"_blank\" rel=\"noreferrer noopener\">Indian company<\/a>, with offices in Houston, admitted to running a major H-1B fraud operation from 2013-2020, using forged contracts and absconding with funds.<\/li><\/ul>\n\n\n\n<ul><li>A <a href=\"https:\/\/www.northjersey.com\/story\/news\/new-jersey\/2020\/09\/15\/nj-firm-pay-345-000-settle-claim-withheld-wages\/5807857002\/\" target=\"_blank\" rel=\"noreferrer noopener\">New Jersey staffing and consulting firm<\/a> was required to pay $345,365 in restitution after it was charged with improperly recruiting foreign workers and withholding wages.<\/li><\/ul>\n\n\n\n<ul><li>In <a href=\"https:\/\/dfw.cbslocal.com\/2021\/12\/08\/department-of-labor-irving-it-company-visa\/\" target=\"_blank\" rel=\"noreferrer noopener\">Texas<\/a>, the U.S. Department of Labor determined that a tech company withheld payments from an H-1B visa worker in an illegal workplace practice called \u201cbenching.\u201d<\/li><\/ul>\n\n\n\n<ul><li>Back in California, a <a href=\"https:\/\/www.mercurynews.com\/2020\/06\/26\/h-1b-and-mountain-view-visa-fraudster-from-china-with-alleged-luxury-tastes-gets-three-years-in-prison\/\" target=\"_blank\" rel=\"noreferrer noopener\">Chinese national<\/a> ran an immigration fraud scheme that raked off millions of dollars while helping thousands of foreign workers to remain in the U.S. illegally.<\/li><\/ul>\n\n\n\n<p>\u201cFraud in the H-1B visa program is nothing new. If the feds did a thorough investigation of all employers that utilize the program, they would find a large number abusing it,\u201d <a href=\"https:\/\/ustechworkers.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Techworkers<\/a> executive director Kevin Lynn stated in an email to FAIR this month.<\/p>\n\n\n\n<p>Increasingly prevalent workplace scams involving foreign nationals prompted bipartisan legislation to scrap the dubious H-1B visa lottery and tighten rules to protect Americans.<\/p>\n\n\n\n<p>\u201cCongress created the H-1B and <a href=\"https:\/\/www.uscis.gov\/forms\/explore-my-options\/l-visas-l-1a-and-l-1b-for-temporary-workers\" target=\"_blank\" rel=\"noreferrer noopener\">L-1<\/a> visa programs to complement America\u2019s high-skilled workforce, not replace it. Unfortunately, some companies are trying to exploit the programs by cutting American workers for cheaper labor,\u201d\u00a0said <a href=\"https:\/\/www.grassley.senate.gov\/news\/news-releases\/grassley-durbin-introduce-bipartisan-h-1b-l-1-visa-reform-legislation\" target=\"_blank\" rel=\"noreferrer noopener\">Sen. Charles Grassley<\/a>, R-Iowa.<\/p>\n\n\n\n<p>Grassley, along with co-sponsor Sen. Richard Durbin, D-Ill., said their <a href=\"https:\/\/www.grassley.senate.gov\/imo\/media\/doc\/grassley_durbin_-_h-1b_and_l-1_visa_reform_act.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">S.3720<\/a> will explicitly prohibit replacement of American workers by H-1B visa holders. Allocations would, for the first time, be ranked to ensure that top science-technology-engineering-mathematics (STEM) degree holders educated in the U.S. have priority for available work visas.<\/p>\n\n\n\n<p>Eliminating the H-1B lottery is crucial. This current randomized system, which dispenses visas irrespective of actual need or merit, has opened the door to fraudsters in America\u2019s tech workplaces.
